1. Acceptance of Terms
By accessing or using the Highlite mobile application (hereby referred to as "Application"), you agree to comply with and be bound by these Terms of Use and our Privacy Policy.
The Service Provider reserves the right to modify these terms at any time. Your continued use of the Application after any such changes constitutes your acceptance of the new terms.
2. Use of Highlite
The Service Provider grants you a limited, non-exclusive, non-transferable, and revocable license to use the Application according to these terms.
You may not use the Application for any illegal or unauthorized purpose.
3. User Accounts
To use certain features of the Application, you must register for an account. You are responsible for maintaining the confidentiality of your account information.
SMS / Text Messaging Program
**Program:** Highlite verification messages. By registering an account and choosing to sign in by phone number, you may receive one-time passcode (OTP) text messages from Highlite for the purpose of verifying your identity. These messages are transactional and are sent only in response to your own action (entering your phone number and tapping "Send code"). Highlite does not send marketing or promotional text messages.
**Opting out:** You can cancel SMS messages at any time by replying STOP to any message. After you send STOP, we will send a confirmation message and you will no longer receive SMS messages from us. To rejoin, simply sign in by phone number again as you did initially, and we will resume sending verification messages.
**Help:** If you experience any issues with the messaging program, reply HELP for assistance, or contact us directly at a.cole@highlite.ai.
**Carrier liability:** Carriers are not liable for delayed or undelivered messages.
**Message and data rates:** Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your login activity. For questions about your text plan or data plan, contact your wireless provider.
**Privacy:** For information on how we handle your data, including mobile and SMS opt-in data, please refer to our Privacy Policy at https://www.highlite.ai/privacy. Mobile information and SMS opt-in/consent data are never shared with third parties or affiliates for marketing or promotional purposes.
5. User-Generated Content (UGC)
You are solely responsible for any content (text, images, videos, comments, etc.) that you create, upload, or share on the Application.
The Application has zero tolerance for objectionable content including but not limited to:
- Hate speech, harassment, or abusive behavior
- Sexually explicit or pornographic material
- Violence, threats, or harmful content
- Illegal activity or promotion of illegal activity
The Application uses both automated filters and manual review to prevent objectionable content from appearing on the platform.
Users may flag or report content they believe violates these Terms. They may also block other users to prevent unwanted interaction.
Reported content will be reviewed within 24 hours, and offending content or accounts may be removed without notice.
6. Prohibited Conduct
You agree not to:
- Post or share objectionable, abusive, or harmful content
- Harass, threaten, or abuse other users
- Attempt to bypass security or moderation systems
- Use the Application in a way that harms the community
7. Termination
The Service Provider may terminate or suspend your access to the Application at any time, without notice, for conduct that they believe violates these terms or is harmful to other users, the Service Provider, or third parties, or for any other reason.
You may stop using the Application at any time.
8. Disclaimers
The Application is provided "AS IS" without any warranties, express or implied.
9. Limitation of Liability
The Service Provider's liability to you is limited to the maximum extent permitted by law.
10. Indemnificatiom
You agree to indemnify and hold the Service Provider harmless from any claims arising out of your breach of these terms or your use of the Application.
11. Governing Law
These terms are governed by the laws of the jurisdiction in which you reside.
12. Dispute Resolution
Any disputes arising out of these terms will be resolved through arbitration.
